Terms of Use — Xray Body Scan Camera
These Terms of Use (the "Terms") govern your use of the mobile app Xray Body Scan Camera (the "App"), developed and published by Marbellaspa app ("we", "us", "our") for Android. By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
- The App is an entertainment simulation: it does not see through the body or clothes and gives no medical information.
- The App is free and supported by advertising.
- Only use photos of yourself, or of people who agree. Never use the App to embarrass, harass or deceive anyone.
- Your camera images and photos stay on your phone. Your privacy is described in our Privacy Policy.
1. Entertainment only — no medical use
All images, X-ray effects, skeletons, "scans", aging previews, energy results and body information shown by the App are simulated for fun. The App does not use X-rays or any medical technology, cannot see through skin or clothing, does not measure skin, muscles, fat, bones, age or energy, and does not detect any condition.
The App is not a medical device and must never be used to make health, medical, safety or other important decisions. The short body facts in the App are general educational information only. For any health question, consult a qualified professional.
2. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download, install and use the App on devices you own or control, for your personal, non-commercial entertainment. The App is licensed to you, not sold.
3. Eligibility
The App is intended for adults aged 18 and over and is not directed at children.
4. Acceptable use
You agree not to:
- use photos or camera images of another person without their permission, or share results in a way that could embarrass, harass, mislead or harm anyone;
- present the App's results as real X-ray, medical or scientific images;
- copy, modify, decompile, reverse-engineer or create derivative works of the App, except where permitted by law;
- interfere with, disrupt or attempt to gain unauthorized access to the App or to the advertising services it uses;
- click on advertisements fraudulently or in any way intended to generate artificial ad activity;
- rent, sell, sublicense, distribute or otherwise commercially exploit the App;
- use the App in any way that violates applicable laws or the rights of others.
5. Your images
You keep all rights to the photos you use and to the images you create with the App. They are processed on your device and are not sent to us. You are responsible for the images you save or share, and for having the right to use the photos you choose.
6. Premium styles and rewarded ads
Some X-ray styles and filters are marked as premium. You can unlock them for 24 hours by choosing to watch an optional rewarded ad to the end. Unlocks have no monetary value, cannot be purchased or exchanged for money, are stored only on your device and may be lost if you uninstall the App or clear its data. We may change which styles are premium and how long they stay unlocked.
7. Advertising
The App displays advertisements provided by Google AdMob, including banner, native, interstitial, app open and optional rewarded ads. We are not responsible for the content of third-party advertisements or for the products, services or websites they promote. Your choices about ad personalization and consent are explained in our Privacy Policy.
8. Intellectual property
The App and all of its content, including its code, graphics, illustrations, effects, sounds, text, logos and the name "Xray Body Scan Camera", are owned by Marbellaspa app or its licensors and are protected by copyright, trademark and other intellectual property laws. Fonts are used under the SIL Open Font License. All rights not expressly granted in these Terms are reserved.
9. Updates and availability
We may update, change, suspend or discontinue the App or any part of it at any time, with or without notice. Some updates may be required to keep using the App. We do not guarantee that the App will always be available, error-free or compatible with every device or camera.
10. Third-party services and app stores
The App is distributed through Google Play and relies on Google AdMob for advertising and on Google Analytics for Firebase for anonymous usage statistics. Your use of those services is also subject to their own terms and policies, including the Google Play Terms of Service and the Google Terms of Service. Images you share are handled by the app you choose, under its own terms.
11. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Marbellaspa app shall not be liable for any indirect, incidental, special, consequential or punitive damages, for any decision taken on the basis of the App's simulated results, or for any loss of data or images, arising out of or related to your use of, or inability to use, the App. Because the App is provided free of charge, our total liability for any claim relating to the App shall not exceed CAD $10. Nothing in these Terms limits any rights you may have as a consumer that cannot be limited by law.
13. Termination
These Terms apply until terminated. You may stop using the App at any time by uninstalling it. We may suspend or end your license to use the App if you breach these Terms. Sections 1, 5, 8, 11, 12 and 14 survive termination.
14. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute shall be submitted to the competent courts of the judicial district of Montreal, Quebec, unless the consumer protection laws of your country of residence require otherwise.
15. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. By continuing to use the App after changes take effect, you accept the updated Terms.
