Terms of Use — Arrow Puzzle
These Terms of Use (the "Terms") govern your use of the mobile game Arrow Puzzle (the "App"), also listed as "Arrow Twist - Puzzle Game", developed and published by Marbellaspa app ("we", "us", "our") for Android and iOS. By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
- The App is free to download and play, and is supported by advertising.
- Coins, stars and other in-game items have no real-world value and cannot be exchanged for money.
- Please use the App fairly and do not attempt to hack, copy or resell it.
- The Android version uses Google Analytics for Firebase to understand how the game is played; the iOS version does not include analytics. Your privacy is described in our Privacy Policy.
1. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download, install and use the App on devices you own or control, for your personal, non-commercial entertainment. The App is licensed to you, not sold.
2. Eligibility
The App is intended for a general audience and is not directed at children under 13. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or legal guardian.
3. Acceptable use
You agree not to:
- copy, modify, decompile, reverse-engineer or create derivative works of the App, except where permitted by law;
- use cheats, bots, exploits or any unauthorized software to alter the App or gain an unfair advantage;
- interfere with, disrupt or attempt to gain unauthorized access to the App or to the advertising services it uses;
- click on advertisements fraudulently or in any way intended to generate artificial ad activity;
- rent, sell, sublicense, distribute or otherwise commercially exploit the App;
- use the App in any way that violates applicable laws or regulations.
4. Virtual items
The App may include virtual items such as coins, stars, hints and second chances ("Virtual Items"). Virtual Items are earned through gameplay or by watching optional rewarded ads. They have no monetary value, cannot be purchased with or exchanged for real money, and cannot be transferred. Your progress and Virtual Items are stored only on your device and may be lost if you uninstall the App, clear its data or change devices. We may modify the balance or behavior of Virtual Items at any time to improve the game.
5. Advertising
The App displays advertisements provided by Google AdMob, including banner, interstitial and optional rewarded ads. Rewards are normally granted when a rewarded ad is watched to the end; if no ad is available, the App may grant the reward without an ad. We are not responsible for the content of third-party advertisements or for the products, services or websites they promote. Your choices about ad personalization, tracking and consent are explained in our Privacy Policy.
6. Intellectual property
The App and all of its content, including its code, graphics, levels, sounds, music, text, logos and the names "Arrow Puzzle" and "Arrow Twist", are owned by Marbellaspa app or its licensors and are protected by copyright, trademark and other intellectual property laws. Fonts are used under the SIL Open Font License. All rights not expressly granted in these Terms are reserved.
7. Updates and availability
We may update, change, suspend or discontinue the App or any part of it at any time, with or without notice. Some updates may be required to keep using the App. We do not guarantee that the App will always be available, error-free or compatible with every device.
8. Third-party services and app stores
The App is distributed through Google Play (Android) and the Apple App Store (iOS). It relies on Google AdMob for advertising on both platforms and, on Android only, on Google Analytics for Firebase for anonymous usage statistics. Your use of those services and stores is also subject to their own terms and policies, including the Google Play Terms of Service, the Google Terms of Service and the Apple Media Services Terms and Conditions.
8.1 Additional terms for the iOS version
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and Marbellaspa app only, not Apple. Apple is not responsible for the App or its content.
- You may use the App only on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App. Support requests should be sent to us at the address in section 14.
- To the extent permitted by law, Apple has no warranty obligation with respect to the App. Any claim relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims, is our responsibility and not Apple's, subject to these Terms.
- You confirm that you are not located in a country subject to a U.S. Government embargo and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Marbellaspa app shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress or Virtual Items, arising out of or related to your use of, or inability to use, the App. Because the App is provided free of charge, our total liability for any claim relating to the App shall not exceed CAD $10. Nothing in these Terms limits any rights you may have as a consumer that cannot be limited by law.
11. Termination
These Terms apply until terminated. You may stop using the App at any time by uninstalling it. We may suspend or end your license to use the App if you breach these Terms. Sections 4, 6, 9, 10 and 12 survive termination.
12. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute shall be submitted to the competent courts of the judicial district of Montreal, Quebec, unless the consumer protection laws of your country of residence require otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. By continuing to use the App after changes take effect, you accept the updated Terms.
